(Suspected) Judicial Conflict of Interest – Tom Cleary’s Fiancé Michelle White and Judge Schell

How was Judge Schell from a legal perspective able to preside over the Cleary Divorce because Tom Cleary brags his Fiancee Michelle White introduced him to Judge Schell in 1994? and they had done real estate transactions together.

Tom Cleary confirmed that his fiancée Michelle White the Fairfax Courthouse Conservator who worked alongside Judge Schell did real estate transactions for Tom Cleary’s financial best interest with companies that Tom Cleary was getting paid on like ReconTrust in 2002 during his marriage to Pam Cleary

Tom Cleary brags that he met Judge Schell, who had worked closely with his fiancée Michelle White ten years prior. Tom Cleary said he told Judge Schell to give his wife of seventeen years, Pam Cleary, nothing.

The Fairfax Court Conservator Michelle White is a conservator for Helen Grove.

Forgery of Public Records: Under Virginia Code § 18.2-168, forging a public record or attempting to use a forged public record is a Class 4 felony punishable by two to 10 years in prison and fines up to $100,000.

A court conservator may be in violation of the Virginia Code § 64.2-3100, which outlines the fiduciary duties of a conservator. This statute requires a conservator to act in the best interests of the protected person and to manage their estate as if it were their own.

The Virginia Code of Ethics for Public Officials and State Employees sets forth guidelines for public officials to avoid conflicts of interest. A court conservator, as a public official, would be subject to these rules. Violations could include engaging in transactions that result in personal financial gain at the expense of the protected person or their estate.

The court conservator is misappropriating funds or property from the estate, they could be charged with embezzlement under Virginia Code § 18.2-111. This crime involves taking property that has been entrusted to one’s care and converting it for one’s own use. (suspected)

The court conservator is engaging in deceitful or fraudulent activities related to the management of the estate, they could face charges under various sections of the Virginia Code related to fraud and deceit.

Tom Cleary said that everybody in the Fairfax court works for him. He thinks he is above the law? Is Tom Cleary above the law?

So how was Judge Schell LEGALLY able to preside over the Cleary case ?

In Virginia, a judge cannot preside over a divorce case if they have a personal relationship with one of the parties involved. This rule is in place to ensure impartiality and maintain the public’s trust in the judicial system. The Virginia Code specifically states that a judge shall disqualify themselves in any proceeding in which their impartiality might reasonably be questioned (Va. Code Ann. § 17.1-261). This includes situations where the judge has a personal bias or interest, or where there is a relationship between the judge and one of the parties.

Tom Cleary brags that Judges cannot give one spouse 100% of the marital assets but because of Tom Cleary’s close relationship with the Judge and Tom Cleary also said because he became an equity owner at his Divorce attorneys building during the marriage he was able to tell the Judge to give his wife NOTHING.

So Tom Cleary kept the billions of dollars and left his wife and three daughters homeless.

Tom brags he was able to keep Pam retirement money that he stole by forging her name and getting notaries to notarize fraudulent documents.

Tom Cleary LIED under oath in his interrogatory said he owned 9712 Spanish Oak in 2012 but the document says he had it way back 1997 through Michelle “Chris” White (Fairfax Courthouse Conservator).
